1.      HOW TO ENTER:

 

1. The TCF Bank Ultimate Fan Shout Out Contest (the “Contest”) begins on Thursday, September 27, 2007 at 5:00PM Eastern Standard Time (“EST”) and ends on Friday, November 23, 2007 at 5:00PM EST.

 

2. To participate in the contest, individuals must register on-site at any one (1) of the following seven (7) Contest entry events:

Participant must complete the contest registration from in its entirety and place it in the entry box. You must enter your first & last name, complete address, city, state, zip code, home telephone number & age), read & sign a WXYT FM/AM (the “Station”) Liability & Publicity release & provide valid identification that establishes the individual’s identity & age.  Qualified participants must then perform a 10 (ten) to 30 (thirty) second “Team Cheer” to be videotaped by representatives of the Station. There can be more than one person in the video, but only one person can register and win the prize.

 

3. The Station is not responsible for an individual’s inability to enter due to difficulty accessing a Contest entry location or for any technical difficulties that may be experienced in the process of taping, storing, uploading or editing an individual’s video performance.

 

4. Individuals may submit only one entry.

 

2.       ELIGIBILITY RESTRICTIONS:

 

1. The contest is open to all persons who are twenty-one (21) years of age or older and who reside in the state of Michigan.  Employees of the Station, its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Detroit metropolitan area and the members of their immediate families or households are ineligible to participate or win. Subject to all applicable federal, state, and local laws. Void where prohibited.

 

2. An individual may win a Station contest with a prize valued at $100 (one-hundred dollars) or less one (1) time every 30 (thirty) days.  An individual may win a Station contest with a prize valued at more than $100 (one-hundred dollars) one (1) time every six (6) months.

 

3. Individuals will be required to sign a Participant & Publicity release, as well as show valid state or government issued ID that establishes his or her identity & age.

 

4. All videos submitted as part of this contest and their content will become the sole property of the Station, and will not be returned.  Station reserves the right to edit a video in its sole discretion prior to posting.  Videos may not display or personally identify any third party other than the contestant, and may not display any features that identify a third party or a third party’s property location.  The Station, at its sole discretion, reserves the right to disqualify and/or destroy any video if such video contains illegal, indecent, pornographic, sexually explicit content, or otherwise offensive material such as aberrational behavior, graphic violence or drug abuse, or if such video contains material whose content is deemed at the sole discretion of the Station to be unsuitable for public viewing or posting via the Internet. 

 

3.      PRIZES:

 

1. Up to one (1) prize will be awarded. Prize includes a trip for two (2) to Minneapolis to attend the Lions/Viking game at the Minneapolis Metro Dome. Prize includes roundtrip coach airfare for two, two-nights hotel accommodations & tickets to the Lions/Vikings game on December 2, 2007.  Approximate retail value of the Prize is $1,500. Certain travel restrictions may apply.  Travel arrangements must be made through Administrator’s agent on a carrier of Administrator’s choice.  No prize substitutions, cash equivalent, or transfer of prizes permitted except at the sole discretion of the Contest Entities.  Prize subject to availability and the Contest Entities reserve the right, at their sole discretion, to award a prize of greater or equal value if the advertised prize is unavailable.  If winner cannot travel on dates specified by Contest Entities, winner may be disqualified and an alternate winner selected.  All other costs not specifically stated herein, including, but not limited to, taxes, meals, tips and ground transportation, are the responsibility of the winner. Winner and travel companion must travel on the same itinerary and are responsible for obtaining all required travel documents.  In addition, travel companion of Winner must be 21 years of age or older. Prize Winner may be required to present a valid credit card upon check in at hotel to cover any incidental expenses. Winner and travel companion are responsible for obtaining travel insurance (and all other forms of insurance) where applicable, at their option, and hereby acknowledge that the Contest Entities have not and will not obtain or provide travel insurance or any other form of insurance. Winner and travel companion must sign a Publicity, Liability Waiver and Travel Release form prior to traveling.  If a selected event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Contest Entities, the Contest Entities’ sole responsibility to a Winner will be to award the remaining available portion of the prize and no substitution will be provided for unawarded portion of prize.  Tickets are subject to terms and conditions as specified by issuer.  Seat locations to be determined by Contest Entities.  Contest Entities reserve the right remove or to deny entry to winner and/or guest if he/she engages in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game.

 

2. All Prize components must be picked up at the office of the Station at the address below.  The winner will forfeit the Prize if not claimed prior to 5:30PM EST on Friday, November 30, 2007.   In the event that the Prize components are mailed to the winner, it will be with the prior written consent of the winner and therefore, the winner assumes the risk of its loss.  The Station is not responsible for the safe arrival of the Prize components. 

 

3. There is no substitution, transfer, or cash equivalent for the Prize, except that he Station may – at its sole discretion – substitute prizes of comparable value or cash.  The Prize is expressly limited to the items described above and does not include taxes, gratuities, ground transfers or any other expenses.  Other restrictions may apply.

 

4.      WINNER SELECTION AND NOTIFICATION:

 

1. Decisions of Station management with respect to the contest are final.

 

2. After each Contest entry event, video entries collected from that event will be posted to the WXYT.com website for a total of seven (7) days as specified in Section 1.b.  During each seven-day posting duration, site visitors will be allowed to vote for the video they like best.  After each seven (7) day voting window, the video with the highest number of votes will become a semi finalist. The seven (7) semi-finalist videos will be posted to the Station’s website for a final seven (7) day voting period.  The semi-finalist video with the highest amount of votes at the conclusion of the final voting round will win the Contest’s grand prize.

 

3. Individuals featured in the videos are not allowed to vote. Site visitors will be allowed to cast a vote only one (1) time during each of the eight (8) weekly voting postings. Individuals that vote or themselves will not count. Individuals that vote multiple times will only count as one vote. When voting, an individual must provide their first & last name, city of residence & their valid e-mail address.

 

4. In the event of a tie in any one of the eight (8) voting periods, a semi-finalist or winner will be selected via random draw.        

 

5. Semi-finalists will be identified by a tally of all votes received, each conducted on the following dates/times:

Semi-Finalist #2:  October 12, 2007 at 12:00PM EST,

Semi-Finalist #3: October 19, 2007 at 12:00PM EST,

Semi-Finalist #4:  October 26, 2007 at 12:00PM EST,

Semi-Finalist #5:  November 2, 2007 at 12:00PM EST,

Semi-Finalist #6:  November 9, 2007 at 12:00PM EST,

Semi-Finalist #7:  November 16, 2007 at 12:00PM EST

 

Grand Prize Winner:  November 23, 2003 @ 12:00PM EST.

 

6. Odds of winning are dependant on the number of entries received & the number of on-line votes cast.

 

7. Winner does not need to be listening or present to win.

 

8. Grand Prize Winner will be notified via telephone call placed on November 26, 2007 at or after 9:00AM EST.  Winners must execute and return an Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within four days of notification attempt or prize will be forfeited.  In the event of Prize forfeiture, the entrant with the next highest level of votes will win the grand prize.  

 

5.      CONDITIONS:

 

1. Payments of all federal, state and local taxes are solely the responsibility of the winner.  Winner will be required to sign an IRS Form W-9 or equivalent.

 

2. By participating in the contest, the winner and guest agrees to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and – where legal – to sign a publicity release confirming such consent prior to acceptance of the prize. 

 

3. Prior to awarding the Prize, the Station – in its sole discretion – may require contest winner and their travel companion, to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.

 

4. The Station, in is sole discretion, reserves the right to disqualify any person tampering with the entry process, the voting process, the operation of the Station’s Web Site or is otherwise in violation of the rules.  It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

 

5. The Station reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement.  If due to circumstances beyond the control of the Station, any Contest-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right – but not the obligation – to cancel or modify the contest and shall not be required to award a substitute prize.

 

6. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of the Station.

 

7. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
